Terms and Conditions

Scope
These terms and conditions apply to all purchases made by private customers from AttiaDesign – Maruan Attia [link to “Imprint”].
Private customers, in this context, are individuals with residence and delivery address in the Federal Republic of Germany, where the ordered goods are not attributable to their commercial or independent professional activity.
Business customers are asked to place orders via the business customer portal [link to business login].

Prices and Shipping Costs
All listed prices are final prices including VAT. The applicable price is the one valid at the time of your binding order.
Shipping costs are additional and depend on the shipping method, as well as the size and weight of the ordered product(s). Details can be found at [link to “Shipping Costs”].

Shipping Costs

Additional shipping charges apply and depend on the shipping method, size, and weight of the ordered product(s). Details can be requested at mail@attiadesign.com.

In the event of a return due to the exercise of your right of withdrawal [link to “Right of Withdrawal”], you are responsible for the cost of return shipping. We will refund the original product price and the standard outbound shipping charges, but not the cost of return.

Payment
Payment is due upon delivery via:

• Credit Card
• PayPal
• Bank transfer

Payment Default
If you are in default of payment, AttiaDesign – Maruan Attia is entitled to charge default interest of 5 percentage points above the base interest rate announced by the Deutsche Bundesbank at the time of the order.
If AttiaDesign – Maruan Attia incurs a higher verifiable loss due to the delay, we may claim that as well.

Right of Retention
You may only exercise a right of retention if your counterclaim is based on the same contractual relationship.

Delivery

1. Delivery is made to the delivery address provided by the customer.
2. If force majeure (natural disasters, war, civil war, terrorist attacks) makes delivery permanently impossible, AttiaDesign – Maruan Attia is released from the obligation to perform. Payments already made will be refunded immediately.
3. AttiaDesign – Maruan Attia may also refuse service if it requires an effort that, considering the contract content and the principle of good faith, is grossly disproportionate to the customer’s interest in fulfilling the contract. Any payments already made will be refunded immediately.
4. Bulky goods (packages larger than 1 sqm) are usually shipped via freight forwarding. AttiaDesign – Maruan Attia explicitly states that such goods will not be carried into the home.

Recommended Return Method

1. Please use the original packaging for returns, even if it was damaged during a functional inspection.
2. Please use the enclosed prepaid return label. This is the easiest and most cost-effective return method. However, you are not obliged to use this method. If you choose a more expensive return method, you may be required to bear the additional cost.

Retention of Title
Until full payment of all claims arising from the purchase contract, the delivered goods remain the property of AttiaDesign – Maruan Attia. During this period, the goods may not be resold or otherwise disposed of. In particular, the customer may not grant third parties any usage rights.

Warranty Rights

1. If the product is defective upon delivery (warranty case), AttiaDesign – Maruan Attia will, at your choice, either replace it or repair it at our cost.
   No warranty case exists in the following situations:
   a) Damage due to misuse or improper use
   b) Damage caused by external influences (e.g., extreme temperatures, moisture, physical or electrical stress, power fluctuations, lightning, static electricity, fire)
2. No warranty is granted for damage caused by unauthorized repairs.
3. If the requested remedy is disproportionate, the claim may be limited to the alternative remedy.
4. For both repairs and replacements, the customer must return the item at AttiaDesign’s expense with the order number to the specified return address.
5. If returning an item for replacement, the customer must compensate for any usage or depreciation not due to the defect.
6. If the customer fails to fulfill their return obligation, they are liable under the applicable laws.
7. If repair or replacement fails within a reasonable period, the customer may reduce the purchase price or withdraw from the contract.
8. Further claims may exist based on a manufacturer’s warranty.
9. The statutory warranty period is 2 years from delivery.

Liability

1. AttiaDesign – Maruan Attia is liable for slight negligence only in the breach of essential contractual obligations and limited to foreseeable damage. This does not apply to damage to life, body, or health.
2. Liability for intentional concealment of a defect or warranty commitments remains unaffected.
3. We are also liable for accidental impossibility during delay, unless the damage would have occurred regardless.
4. Personal liability of legal representatives, agents, or employees for slight negligence is excluded.

Applicable Law
This contract is governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Sales Convention. Mandatory consumer protections in your country of residence remain unaffected.

Jurisdiction
If you are not a resident of Germany or your residence is unknown at the time of the complaint, the place of jurisdiction is [location of shop operator].

Dispute Resolution
As required by Article 14 (1) ODR Regulation and § 36 VSBG:

We are not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.

Final Provisions

1. If any provision of this contract is or becomes invalid, the validity of the rest of the contract shall remain unaffected, provided that it does not unreasonably disadvantage either party.
2. Amendments or additions to this contract must be in writing.
